2. Purpose and scope of application
These general conditions define the rights and obligations applicable to any order placed on the site www.selinabodyart.com.
Any order implies full and complete acceptance of these conditions, without exception or reservation.
They apply only to consumers acting for non-professional purposes.
Professionals are invited to contact us in advance.
3. Products
The jewelry offered is new, never worn, sterile (or sterilizable) and selected from certified suppliers respecting the quality and hygiene standards imposed by the Association of Professional Piercers (APP) .
They are made of safe materials (ASTM-F136 implantable titanium, certified 14K/18K gold, etc.).
The photographs on the site are as faithful to reality as possible, but variations in color may appear depending on the screen. These differences do not entitle you to any refund or exchange.
Use of Online-Purchased Jewelry at the Studio
If you wish to have a piece of jewelry seen on the online shop inserted during a piercing or jewelry change at the studio, please do not purchase it online.
Instead, contact me by email at selina.bodyart@gmail.com so that I can reserve the desired jewelry for you at the studio. This will also allow you to avoid shipping costs.
For hygiene and safety reasons, jewelry purchased online cannot be inserted during a piercing or jewelry change.
It is not possible to guarantee that the packaging has not been opened or that the jewelry has not been handled or worn.
Therefore, any jewelry already delivered to the customer is considered a product intended for personal use only and cannot be reused at the studio.
4. Orders
Orders are processed within 3 to 7 business days after payment validation, subject to product availability.
As some jewelry is ordered on demand, delivery times may be extended. In the event of an unusual delay, the customer will be notified by email.
The seller reserves the right to refuse an order in the event of suspicion of fraud, abuse or misuse.
5. Prices and promotions
Prices shown are in euros, all taxes included (VAT included).
Any delivery costs are indicated separately before confirming the order, so that the customer knows the total price to pay before confirming the purchase.
Promotions, discounts or special offers are valid while stocks last, for the duration mentioned on the site or until cancelled by Sélina Bodyart.
Sélina Bodyart reserves the right to terminate a promotional offer at any time, in accordance with the announced conditions.
6. Payment
Payment is made online using the secure payment methods offered at checkout.
No order will be processed without prior full payment.
The customer is responsible for the accuracy of the billing and payment information provided when ordering.
7. Delivery
Orders are shipped via a tracked delivery service.
A tracking number is sent to the customer by email as soon as the package is sent, allowing them to track the delivery online.
Delivery Areas: Currently, online orders are limited to European countries. If your country is not listed as a destination when ordering, you can contact us at the email address above to discuss adding it and agree on shipping arrangements.
In the event of delay, loss, theft or damage to the package before receipt, Sélina BodyArt remains responsible for the proper execution of the delivery, in accordance with the Belgian Code of Economic Law.
In practice, the customer is invited to contact the carrier as a priority using the tracking number provided in order to initiate an investigation.
We of course remain available to assist the customer in their dealings with the carrier.
If the order cannot be located or the product is found to be damaged upon receipt, we will offer a replacement or full refund, as appropriate.
Furthermore, the customer must ensure that they provide a correct and complete delivery address. In the event of an error on their part, any reshipping costs will be their responsibility.
If the package cannot be delivered due to an error in the address provided by the customer, an incomplete address, or because the package was not collected within the time limits from the collection point or the carrier, Sélina Bodyart cannot be held responsible for the loss or return of the package.
If the package is returned to the studio, a new shipment may be offered, but the customer will be responsible for shipping costs, as well as any processing or repackaging fees. If the package is permanently lost for one of the above reasons, the customer will have to reorder at their own expense. No replacement or refund will be made in this case.
8. Right of withdrawal
In the event of valid exercise of the right of withdrawal, the customer will be reimbursed for the full amount paid for the returned order. This includes the price of the returned product(s) as well as the initial delivery costs (calculated on the basis of the standard delivery method offered). However, if the customer had expressly chosen a more expensive delivery method than standard delivery, the additional cost will not be reimbursed. In accordance with the law, the direct costs of returning the product subject to withdrawal remain the responsibility of the customer, unless exceptionally agreed otherwise by Sélina BodyArt. The refund will be made within 14 days from the recovery of the returned item or receipt of proof of shipment by the customer.
9. Complaints, Returns and Refunds
Any claim (order error, missing item, or issue upon receipt) must be submitted by email within 24 hours after delivery of the order, at the following address: selina.bodyart@gmail.com.
After this period, the sale will be considered definitively accepted and no claim will be processed.
In the case of damaged jewelry upon receipt, you have 24 hours to contact us at selina.bodyart@gmail.com with the subject line “Damaged Jewelry Return”, attaching clear photos of the item and its packaging.
If a return is accepted, you will receive instructions for sending the item back. However:

The item must be returned via tracked or registered mail, at the customer’s expense. Initial shipping costs are non-refundable.

The refund will be issued within 14 days after receipt of the item (or proof of shipment) and verification of the jewelry.

Worn, altered, or items sent without their original packaging will not be refunded.
No return will be accepted:
- For jewelry that has been worn, tried on, or whose packaging has been opened or damaged,
- For returns without valid proof of shipment,
- For jewelry different from the items originally ordered.
10. Warranty and conformity
Right of withdrawal
In accordance with the Belgian Code of Economic Law, the customer has a period of 14 calendar days from receipt of their order to exercise their right of withdrawal, without having to provide a reason and without penalty.
To exercise this right, simply send an email of withdrawal to webshop.selinabodyart@gmail.com , before the expiry of the 14-day period.
Exceptions to the right of withdrawal:
For obvious reasons of hygiene (article VI.53 of the Code of Economic Law), the right of withdrawal does not apply to jewelry that has been opened, tried on or worn.
All returned jewelry must be in its original condition, sealed in its unopened sterile bag.
Jewelry whose sterile packaging has been opened cannot be refunded.
Return costs and terms: The product must be returned at your expense, by tracked or registered mail, within 14 days of sending the withdrawal request. In the absence of valid proof of sending or actual receipt of the jewelry, no refund can be made.
Refund: In the event of a valid exercise of the right of withdrawal, the price of the returned jewelry will be refunded to you, as well as the initial standard delivery costs.
If you had opted for a more expensive delivery method (for example express delivery), only the costs corresponding to standard delivery will be refunded.
The refund will be made within 14 days after receipt of the returned jewel (or proof of shipment), after verification of its correct condition.

In accordance with regulations, the customer can use the standard withdrawal form below to notify their decision to withdraw. Simply complete and return this form (by email or post) only if you wish to withdraw from the sales contract:
11. Gift cards
Gift cards are only available at the physical studio , not on the website. They are valid for 6 months from the date of purchase, and can be used once on all of our products or services in the studio. They are neither refundable nor exchangeable, even in the event of loss or theft. Any unused balance on a gift card cannot be claimed or refunded in cash.
12. Personal data
The personal data collected is used only for order processing and customer account management, and after-sales service, in accordance with the General Data Protection Regulation (GDPR).
They are not transmitted to any third party, except for service providers essential to the transaction (e.g. secure payment or delivery services), or legal obligation.

14. Applicable law – Disputes
These general terms and conditions of sale are subject to Belgian law. In the event of a dispute not resolved amicably, the courts of the district of Brussels shall have sole jurisdiction, subject to any mandatory legal provisions more favorable to the consumer (for example, special territorial jurisdiction provided for by law).
In accordance with Regulation (EU) No. 524/2013, the customer is informed that he or she may also use the European Online Dispute Resolution (ODR) platform, accessible at the following address: http://ec.europa.eu/odr. This platform allows you to find an independent mediation system to resolve consumer disputes online.
15. Claims (reporting period for a defect)
We invite the customer to check the condition of their order upon receipt and to report any apparent issue as soon as possible (preferably within 24 hours of delivery) by sending a detailed email to selina.bodyart@gmail.com.
This responsiveness will allow for a more efficient handling of the claim (for example, in the case of a missing item, a damaged product, or a preparation error).
However, the absence of immediate notification does not mean you lose your rights: the customer still benefits from the 2-year legal warranty of conformity for any manufacturing defect or lack of conformity that may appear in the product.
(In other words, not reporting a defect within 24 hours does not amount to a definitive acceptance of the condition of the delivered goods.)
